Some researchers have argued that firms with favorable environmental performance are more likely to provide voluntary environmental disclosure, while others have argued that firms with poor environmental performance are most likely to disclose. Researchers in the business and society area have yet to address corporations that receive special government subsidies (a.k.a. corporate welfare). This article makes the argument that given their subsidized status, the citizenship of those companieswarrants scrutiny, tests the common notion that large companies in particular industries derive the greatest benefit from corporate welfare, and determines what, if any, relationship corporate welfare has with corporate citizenship. Results show that large companies in particular industries are the most likely recipients of corporate welfare. (...) Racial injustice in employment demands the attention of business organizations because it profoundly shapes our life prospects. While comparing the ideal of perfectly equal opportunity with its invariably imperfect alternatives can impede reform, the true challenge lies in addressing persistent inequities as we strive for equality. This article introduces “shared inequity” as a frame of reference for assessing workplace racial disparities and emphasizing a collective responsibility to remedy systemic issues. In critiquing an exaggerated notion of meritocracy, I emphasize that structural (...) racism, rather than just individual acts, facilitates collective advantages, especially for White males. Hence, it is morally fitting to frame racial justice in employment, not only in terms of perfect equality, but also in terms of justly sharing an imbalance that cannot be corrected without counterbalance. Although stakeholder theory is concerned with stakeholder engagement, substantive operational barometers of engagement are lacking in the literature. This theoretical paper attempts to strengthen the accountability aspect of normative stakeholder theory with a more robust notion of stakeholder engagement derived from the concept of good faith. Specifically, it draws from the labor relations field to argue that altered power dynamics are essential underpinnings of a viable stakeholder engagement mechanism. After describing the tenets of substantive engagement, the paper draws from the (...) labor relations and commercial law literatures to describe the characteristics of good faith as dialogue, negotiation, transparency, and totality of conduct; explains how they can be adapted and applied to the stakeholder context; and suggests the use of mediation and non-binding arbitration. The paper concludes by addressing anticipated objections and shortcomings and discussing implications for theory and research. (shrink)

This article argues that the concept of deliberation is construed too narrowly in political corporate social responsibility (CSR) and that a concept of deliberation for political CSR should err toward useful speech acts rather than reciprocity and charity. It draws from the political philosophy, labor relations, and business ethics literatures to outline a framework for an extended notion of deliberative engagement. The characters of deliberative behavior and deliberative environment are held to generate four modes of engagement: strategic deliberation, unitarist deliberation, (...) pluralist deliberation, and deliberative activism. The article concludes by arguing that political CSR will be better positioned to realize its potential by moving away from primarily consensus-centered objectives to a more responsive range of deliberative goals and practice. Social responsibility is addressed to corporations, but can also be applied to other powerful organizations. This study tests the impact of labor union social responsibility on key measures of labor union attachment. After developing a scale of labor union social responsibility, craft union apprentice workers were surveyed and their responses analyzed with structural equation modeling. Labor union social responsibility was directly and positively related to union commitment and job satisfaction. Union commitment and job satisfaction fully mediated the negative relationship between (...) labor union social responsibility and propensity to withdraw from the union, and the positive relationship between labor union social responsibility and union participation. The results suggest that labor union social responsibility can enhance union attachment and inform union strategy. (shrink)

ABSTRACT:Globalization has brought increased attention to the notion that labor rights such asfreedom of association—the right of workers to organize a union—are fundamental human rights. However, the vigorous opposition to freedom of association by US firms is largely ignored in the business ethics literature and exacerbated by compensatory corporate citizenship rating mechanisms that tend to mask labor rights deficiencies. I argue that because freedom of association is a hypernorm, instrumental to fully realizing basic human rights, labor rights and human rights (...) are largely inseparable. Thus, respect for labor rights is a non-substitutable requisite of corporate citizenship. I conclude by providing examples of corporate labor relations strategies that respect freedom of association and business firms that are leading the way. (shrink)

The paper argues that an ethical firm has cause to realize and to respect, in good faith, the decision of workers regarding labor unions, and proceeds along the following lines. First, the employer is due appropriate deference the bounds of which should be determined in conjunction with employees, as they are the most closely affected party. Second, employee preferences for defining the employment relation and appropriate deference are best reflected through autonomous voice. Third, autonomous voice is assured by the right (...) to free association and generally achieved through labor unions. Fourth, because employment is so important to a dignified existence, an economically just system of employment requires respect for workers’ choice regarding labor unions. Institutional and resource dependency theories are used to develop a conceptual framework that describes how an “issue pacesetter” affects corporate issue management. The pacesetter model is developed in the following steps: changed stakeholder expectations, pacesetter emergence, heightened attention and pressure, decision making under pressure, and implementation and compliance. The model is then applied to analyze the confrontation between the mainline pharmaceutical industry and AIDS activists and stakeholders over access to AIDS medications in Africa. Analysis of this confrontation demonstrates that issue (...) pacesetters increased the effectiveness of stakeholders in placing institutional pressure on the pharmaceutical industry and contributed to the industry changing its regulations regarding access to AIDS drugs. The divest movement has focused attention on strategic and ethical differences in the practice of socially responsible investing and highlighted an unnecessary bifurcation of best-of-class engagement and divestment. Although best-of-class engagement is favored as a contemporary and pragmatic approach, this paper calls for a more pronounced recognition of absolute dealbreakers and divestment as an underpinning for best-of-class engagement. After linking divestment and best-of-class engagement to their foundations of absolutism and relativism, respectively, I critique best-of-class engagement and argue that without a (...) distinct and explicit role for divestment, best-of-class strategies are ethically and strategically fraught. Following a discussion of which types of issues suggest divestment or best-of-class engagement, I identify the Norway Government Pension Fund as a noteworthy example, and posit that divestment and engagement are best presented and employed in tandem, particularly for issues that have yet to be addressed by law and convention. This research draws on complexity theory to provide an alternative conceptualization of issue management. We use six dynamics of complexity drawn from complex adaptive systems—equipoise, turbulence, sensitive conditions, bifurcation, attractor emergence, and symmetry breaking—to develop a metaphorical framework that describes what occurs during various periods of issue activity and what propels issues from one period of activity to another. We illustrate the framework with a case study of the pharmaceutical industry response to the HIV/aids pandemic in Sub-Saharan Africa. Flagging labor governance in far-flung supply networks has prompted greater scrutiny of instrumental CSR and calls for models that are tethered more closely to accountability, constraint, and oversight. Political CSR is an apt response, but this paper seeks to buttress its deliberative moorings by arguing that the agonist notion of ‘domesticated conflict’ provides a necessary foundation for substantive deliberation. Because deliberation is more viable and effective when coupled with some means of coercion, a concept of CSR solely premised on reciprocal (...) corporate-stakeholder engagement is pre-mature; efforts should first be directed toward the antecedents of reciprocity and how it is to be achieved, and only then does deliberation become a reliably substantive exercise. The resulting account of agonistic CSR is generated through agonistic principles of realism, pro-action, contestation, and countervailence, and illustrated by the Bangladesh Accord. (shrink)

In this article, I will discuss possible differences between ecosystems and organisms on the basis of their intrinsic complexity. As the concept of complexity still remains highly debated, I propose here a practical and original way to measure the complexity of an ecosystem or an organism. For this purpose, I suggest using the concept of logical depth (LD) in a specific manner, in order to take into account the difficulty as well as the time needed to generate the studied object. (...) I illustrate this method with fully controlled Daisyworld simulations (i.e., simulations based on the Gaia hypothesis) that have often been proposed to mimic living systems. The method consists of the following sequential stages: (1) identification of the shortest program able to numerically model the studied system (also called the Kolmogorov–Solomonoff complexity); (2) running the program, once if there are no stochastic components in the system, several times if stochastic components are there; and (3) computing the time needed to generate the system with LD complexity. This measure is supposed to estimate the system complexity. It appears in this study that LD estimations fit well with the intuition we have of complex systems, with higher complexities being found for more realistic Daisyworlds. With such a method of capturing the time needed to build a system, we expect to detect in future studies any quantified differences between complex ecosystems and organisms. (shrink)

Coen offers a unified explanation of natural selection, development, learning and cultural change, based on seven fundamental principles: population variation, persistence, reinforcement, competition, cooperation, combinatorial richness and recurrence. I discuss whether all seven principles are justified, successfully fit the four processes, encompass life processes only, and have any strong explanatory import. I find each of these claims doubtful.

This paper compares and contrasts three groups that conducted biological research at Yale University during overlapping periods between 1910 and 1970. Yale University proved important as a site for this research. The leaders of these groups were Ross Granville Harrison, Grace E. Pickford, and G. Evelyn Hutchinson, and their members included both graduate students and more experienced scientists. All produced innovative research, including the opening of new subfields in embryology, endocrinology and ecology respectively, over a long period of time. (...) Harrison's is shown to have been a classic research school; Pickford's and Hutchinson's were not. Pickford's group was successful in spite of her lack of departmental or institutional position or power. Hutchinson and his graduate and post-graduate students were extremely productive but in diverse areas of ecology. His group did not have one focused area of research or use one set of research tools. The paper concludes that new models for research groups are needed, especially for those, like Hutchinson's, that included much field research. (shrink)

BackgroundLiving labs are realistic environments designed to create links between technology developers and end-users (i.e. mostly older adults). Research in LLH (Living labs in health) covers a wide range of studies from non-interventional studies to CT (clinical trials) and should involve patients with neurocognitive disorders. However, the ethical issues raised by the design, development, and implementation of research and development projects in LLH have been the subject of only little interest thus far.ObjectiveOur aim was to determine a pragmatic, ethical and (...) regulatory correct approach to seek the informed consent of patients with neurocognitive disorders according to the different types of studies carried out in European LLH, with a focus on the French context.MethodsA narrative review of regulatory texts and clinical articles was conducted, and a pragmatic procedure to determine the decision-making capacity of older adults in LLH was proposed.ResultsIndividuals must be adequately informed and freely agree to participate in CT. The capacity to consent should be assessed in CT including cognitively impaired older adults. We propose the following steps: first to assess for delirium using the 4 ‘A’s Test (4AT) or the 3-min Diagnostic interview for Confusion Assessment Method (3D-CAM), second to search for medical history of major neurocognitive disorder, and third to assess the decision capacity using the University of California, San Diego Brief Assessment of Capacity to Consent (UBACC).ConclusionsIncluding individuals with neurocognitive disorders in research implies using an efficient and pragmatic strategy to inform participants and obtain their consent. The tool we offer here may be useful in the routine operation of LLH but can also be extended to all CT with this population. (shrink)

This paper introduces freely improvised joint actions, a class of joint actions characterized by highly unspecific goals and the unavailability of shared plans. For example, walking together just for the sake of walking together with no specific destination or path in mind provides an ordinary example of FIJAs, along with examples in the arts, e.g., collective free improvisation in music, improv theater, or contact improvisation in dance. We argue that classic philosophical accounts of joint action such as Bratman’s rule them (...) out because the latter require a capacity for planning that is idle in the case of FIJAs. This argument is structurally similar to arguments for minimalist accounts of joint action, and this invites a parallel minimalist account, which we provide in terms of a specific kind of shared intentions that do not require plan states. We further argue that the resulting minimalist account is different in kind from the sort of minimalism suggested by developmental considerations and conclude in favor of a pluralistic minimalism, according to which there are several ways for an account of joint action to be minimal. Two major works in recent evolutionary biology have in different ways touched upon the issue of cultural replicators in language, namely Dawkins’ Selfish Gene and Maynard Smith and Szathmáry’s Major Transitions in Evolution. In the latter, the emergence of language is referred to as the last major transition in evolution, a claim we argue to be derived from a crucial property of language, called Duality of Patterning. Prima facie, this property makes natural language look like a structural equivalent to DNA, (...) and its peer in terms of expressive power. We will argue that, if one takes seriously Maynard Smith and Szathmáry’s outlook and examines what has been proposed as linguistic replicators, amongst others phonemes and words, the analogy meme-gene becomes problematic. A key issue is the fact that genes and memes are assumed to carry and transmit information, while what has been described as the best candidate for replicatorhood in language, i.e. the phoneme, does by definition not carry meaning. We will argue that semiotic systems with Duality of Pattering force us to reconsider either the analogy between replicators in the biological and the cultural domain, or what it is to be a replicator in linguistics. IntroductionThe observation that animals may respond to emotional states of conspecific or even hetero-specific individuals is not new. Darwin broached the question by underlying the ability of animals to express sympathy, i.e. the response to non-self-emotional status, and this across species barriers. More importantly, he tried to find the evolutionary origin of this animal trait, suggesting that it evolved from the selective advantages of kinship behaviour in the struggle for life (Darwin, 1872). Such a behaviour corresponds, for instance, to alloparental (...) care relatively common in mammals and birds, and now also characterized in fishes and insects (Josi, Taborsky, & Frommen, 2019; Wu, Walser, Sun, & Kölliker, 2020). After more than one century, the need of defining what exactly non-human animals are able to feel, and from this starting point, rethink the legal status and place of animals in human societies, suddenly arises. This can mainly be considered as an indirect consequence of people awareness of human-driven dramatic impacts on global climate, biodiversity, but also on a more daily basis on animal life and welfare. However, because assessable currencies are required to establish laws, animals were classified into categories based on ecological (e.g. invasive species, pest, wild, domestic), biological (e.g. vertebrates and invertebrates) or cognitive (e.g. primates, cephalopods) traits. Pindar, perhaps more than any other ancient poet, seems to demand from his interpreters declarations of their critical premises. In recent years scholars customarily have made initial acknowledgment to the work of E. R. Bundy, as psychoanalysts must to Freud, before they begin to offer their own modifications to and expansions of his fundamental work. Much contemporary scholarship has concentrated on the identification and classification in the odes of the elements whose function Bundy labelled and explained. But useful as this (...) type of analysis has been for exorcising the demon of biographical interpretation, it has, like all orthodoxies, prevented perception of other equally important truths. It constitutes no radical heterodoxy to try to account for the fact that each individual ode, for all its dependence on common conventions of structure and of content, makes a different impression. Nor is it unreasonable to try to explain what makes Pindar's style and approach distinctive.In my own work I have argued, though perhaps not always convincingly, that language as well as structure contributes to an ode's coherence. Scholars trained in America are more willing to assume that repetition of phrase or theme within a poem has significance, and that metaphors can simultaneously bear more than one connotation. The issues at stake have most recently been delineated by Michael Silk, in his discussion of the effect of metaphor in archaic poetry: ‘By “patent”, I mean effects whose existence is not in doubt, though their character may be disputed; by “latent”, those whose effective significance is so tenuous or marginal that one resents the impression of solidity that even mentioning them produces. Such insensitivity is more common than it should be among American classicists, many of whom have also been influenced by the “New Criticism”…’ As illustration of the erroneous American approach Silk cites Cedric Whitman's description of the thematic relation of fires in theIliad.Silk himself avoids the trap Whitman falls into by considering only ‘patent’ metaphors, and these consistentlyout of context, so that there is no necessity to comment on the existence or non-existence of thematic connections among them. But it is possible—at least logically—to frame the question differently, and to ask whether a metaphor cannot have patent and latent associations at the same time. (shrink)

Studies examining the ways in which the training of engineers and scientists shapes their research strategies and scientific identities.

Each month brings new scientific findings that demonstrate the ways in which human activities, from resource extraction to carbon emissions, are doing unprecedented, perhaps irreparable damage to our world. As we hear these climate change reports and their predictions for the future of Earth, many of us feel a sickening sense of _déjà vu_, as though we have already seen the sad outcome to this story. Drawing from recent scholarship that analyzes climate change as a form of “slow violence” that (...) humans are inflicting on the environment, _Climate Trauma_ theorizes that such violence is accompanied by its own psychological condition, what its author terms “Pretraumatic Stress Disorder.” Examining a variety of films that imagine a dystopian future, renowned media scholar E. Ann Kaplan considers how the increasing ubiquity of these works has exacerbated our sense of impending dread. But she also explores ways these films might help us productively engage with our anxieties, giving us a seemingly prophetic glimpse of the terrifying future selves we might still work to avoid becoming. Examining dystopian classics like _Soylent Green _alongside more recent examples like _The Book of Eli_, _Climate Trauma_ also stretches the limits of the genre to include features such as _Blindness_, _The Happening_, _Take Shelter_, and a number of documentaries on climate change. These eclectic texts allow Kaplan to outline the typical blind-spots of the genre, which rarely depicts climate catastrophe from the vantage point of women or minorities. Lucidly synthesizing cutting-edge research in media studies, psychoanalytic theory, and environmental science, _Climate Trauma _provides us with the tools we need to extract something useful from our nightmares of a catastrophic future. ACESSO À JUSTIÇA: DELINEAMENTOS GERAIS E ANÁLISE NO PROJETO DE NOVO CÓDIGO PROCESSUAL CIVIL.

RESUMO Neste trabalho, proponho uma leitura de aspectos discursivos do curta-metragem de ficção Recife frio, de Kleber Mendonça Filho, com o objetivo de refletir sobre como a hibridização de gêneros na obra, decorrente da presença de gêneros intercalados no filme, cria sentidos e provoca determinada postura na interlocução com os espectadores. Para tanto, discuto alguns conceitos-chave da teoria bakhtiniana, descrevo momentos específicos do curta-metragem e proponho análises pontuais de determinadas cenas ou sequências. A forma de diálogo com o corpus segue (...) os pressupostos da poética sociológica que perpassa as discussões empreendidas por Bakhtin e pelos demais pesquisadores do Círculo. As reflexões apresentadas apontam para um jogo de cena entre ficção e realidade, que, no curta, são acionados pela presença de elementos que podem ser associados ao gênero documentário. ABSTRACT This paper proposes a reading of discursive aspects in Recife Frio, a short film by Kleber Mendonça Filho. It aims at reflecting on how genre hybridization, which results from the presence of incorporated genres, creates meanings and provokes certain attitudes in the interaction between film and spectators. To do so, I discuss some key concepts of Bakhtinian theory, describe specific moments of the short film, and finally conduct a pointed analysis of specific scenes or sequences. This form of dialogue with the corpus follows the assumptions of the sociological poetics that traverse the discussions done by Bakhtin and the other researchers of the Circle. These reflections point to a play between fiction and reality, which in the film is triggered by the presence of elements that may be associated to the documentary genre. (shrink)

Throughout the long history of Classic Maya hieroglyphs, a logosyllabic writing system used from the late first millennium BCE through the mid-second millennium CE in southern Mesoamerica, the most commonly recorded phonetic value was the syllable u (/ʔu/). With over a dozen different u hieroglyphs, Classic Maya scribes had more options for recording /ʔu/ than any other syllable or logograph. Cognitive approaches to writing systems typically attribute graphemic variation (i.e., alternation between signs with equivalent linguistic value) to semantic differences like (...) animacy or to non-linguistic factors like identity. Distribution of Classic Maya u hieroglyphs, however, suggests that morphosyntactic context influenced which grapheme scribes wrote and when. This case suggests that scribal knowledge of Classic Maya hieroglyphs included ideas about writing's relationship to language. It also highlights the cognitive relevance of morphosyntax for a writing system's users as they differentiate among graphic signs with identical linguistic denotation. (shrink)

A partir da concepção de um racionalismo integral, em que vigora o ideal da plena demonstrabilidade segundo o paradigma identitário da verdade, configura-se em Leibniz a questão da universalidade, que seria enunciada com mais pertinência como a do determinismo universal. São dois aspectos de uma mesma questão: em primeiro lugar, a universalidade no sentido arquitetônico, correspondente à totalidade; em segundo lugar, a determinação absoluta do indivíduo singular. Tanto num caso quanto no outro, a plena determinação é inalcançável para a mente (...) humana. Mas as operações simbólicas de determinação, permitem, de alguma maneira, contornar a impossibilidade de uma visão simultânea e articulada de todos os elementos de um composto e, assim, nos encaminham na direção de uma universalidade determinante. How can we find any satisfying assignment for a Boolean formula that has many satisfying assignments? There exists an obvious randomized algorithm for solving this problem: one can just pick an assignment at random and check the truth value of the formula for this assignment, this is iterated until a satisfying assignment occurs. Does there exist a polynomial-time deterministic algorithm that solves the same problem? This paper presents such an algorithm and shows that its worst-case running time is linear when (...) input formulas are in k-CNF and a fraction of satisfying assignments is greater than a constant. This algorithm is almost the same as the algorithm proposed by Monien and Speckenmeyer in the early 1980s for less than 2n steps 3-SAT decision.Another result of this paper is that if a formula in k-CNF has many satisfying assignments, then there exists a short satisfying assignment, i.e. an assignment of truth values to a small number of variables. The proposed algorithm yields just such a short satisfying assignment. We also show that there exist formulas in general CNF having many satisfying assignments, that have no short satisfying assignments. (shrink)
